Inventory Counting Employees Sue WIS Over Labor Law ViolationsLear & Werts L.L.P. has a filed a collective action lawsuit on behalf of WIS Holding Corporation inventory counting employees for unpaid wages and overtime.
Lear & Werts represents former inventory counting employees in wage and hour actions against WIS Holding Corporation (also known as WIS International) in two federal lawsuits - one in Missouri and one in California. The California case is a nation-wide case and any current or former WIS employee may be eligible to join the California case regardless of where he or she lives. These cases allege that WIS consistently violates federal and state wage and hour laws by failing to accurately record all time worked and failing to pay earned wages and overtime. Plaintiffs allege, among other things, that WIS requires its employees to work "off the clock" by not paying for work performed pre-shift, post-shift, and while traveling between assignments. The plaintiffs further allege that the effect of this policy was that WIS Inventory Associates were not paid all of the wages and overtime they earned. The California case is Chavez et al v. WIS Holdings Corp et al, Case No. 3:07-cv-01932-L-NLS filed in the U.S. District Court for the Southern District of California and is pending before the Honorable District Judge M.
