Though every case is different, below are a few of our success stories. Clients Paid Salary and Denied Overtime Pay Lear & Werts represented former Mitek employee Mark Schleipfer - and a class of those similarly situated to him - in their claims against Mitek and its CEO/President, Loyd Ivey. The case was entitled Mark Schleipfer v. Mitek Corporation and Loyd Ivey, Case No. 1:06-CV-109 and was pending in the United States District Court for the Eastern District of Missouri. The judge assigned to the case was the Honorable Catherine D. Perry. The case has been resolved to the satisfaction of all parties. The case was based on the Fair Labor Standards Act (FLSA) and sought compensation for unpaid overtime. The lawsuit alleged that employees were improperly paid a salary without overtime compensation in work weeks when so-called "exempt" work was not the employee's primary duty. Specifically, the lawsuit alleged that the class members were required to perform non-exempt promotional work and/or manual labor and were not paid overtime for hours worked over 40 in a given week. Click here for more information. Client Injured By Uninsured, Homeless, Motorist In a recent case, our client, and his wife, were severely injured by an uninsured, and homeless, driver. Our client's medical bills from his initial hospital stay were more than the limits to his uninsured motorist policy. This case came to our office after another attorney failed to pursue all avenues of recovery to our clients' expectations. During the course of this representation, our attorneys negotiated with our clients creditors to help their recovery from the financial burdens of the case as well as with the short term disability insurance company whose delay in paying caused additional stress and financial pressures on our client. This case required a creative approach to identify all parties responsible for the accident in order to secure a fair settlement for our clients. Clients Hit By Tractor-Trailer While Moving Cross-Country Our office resolved a case involving two young men who were driving through Missouri on their way from Michigan to Arizona. They were driving a rented moving truck and towing the driver's pick-up truck. During the night, they were rear-ended by an over-the-road trucker. The impact was so severe that it flipped their truck off the roadway and into a ravine. The passengers sustained moderate physical injury, but were both greatly traumatized by the incident. The effect of this accident was so severe that it even impacted both men's spouses. Our office pursued a case on their behalf in the federal courts. Ultimately, this case settled after sustained negotiations between our office, counsel for the trucking company and various other entities. Complex Family Business Dispute Promptly Resolved In this next case, our clients were a married couple who were business partners with a family member. When the business relationship failed, our clients turned to Lear & Werts for help. In this situation, the businesses assets were such that a judicial division of the business would have been to everyone's detriment. Fortunately, our attorneys were able to negotiate a buy-out that was to everyone's advantage. Substantial Business Loss Averted The attorneys at Lear & Werts L.L.P. represented a company in a complex contract dispute. Our client had promised to provide all of the products another company required for a certain period of time in exchange for certain payments. The other side of this contract defaulted and decided to buy their products from another supplier. Our office filed suit in federal court and, through the use of the court's Early Assessment Mediation program, was able to rapidly, and inexpensively, secure a favorable settlement in a case that our client almost chose not to pursue due to its complexity. |
